Worker Advocate Urges Labor Board to Affirm Right to Object to Subsidizing Union Politics in Languishing Cases

Numerous cases before NLRB lay dormant as workers suffer from union policies designed to discourage objections to paying full union dues

Washington, DC (January 13, 2011) – The National Right to Work Foundation is urging the National Labor Relations Board (NLRB) to promptly resolve four cases almost identical to one decided last year by the Board as independent-minded workers wait for a resolution.

The Foundation – the nation’s premier advocate on behalf of workers who suffer from the abuses of compulsory unionism – scored a legal victory in August 2010 for workers who were subjected to a burdensome machinist union boss policy requiring employees to annually renew their objection to supporting union politics and other non-bargaining expenses or be converted back to paying full union dues.

The NLRB in Washington, DC determined that the machinist union’s annual objection requirement for workers who choose to refrain from union membership is illegal under Foundation-won U.S. Supreme Court precedent upheld in Communications Workers v. Beck (1988).Under Beck, nonmember employees in states without Right to Work laws cannot be compelled to pay for union politics, lobbying, and member-only events.

In a letter penned by Foundation Vice President & Legal Director Raymond LaJeunesse to the NLRB, the Foundation asks that the Board apply their August 2010 decision to four virtually identical cases still pending before the Board.

Right to Work Foundation assists Sacramento healthcare providers coerced into union forced dues ranks

Sacramento, CA (December 20, 2010) – A Sutter Roseville Medical Center healthcare professional has filed federal labor charges against a local union for coercing her and her colleagues into paying forced union dues.

With free legal aid from National Right to Work Foundation attorneys, Mary Massen filed the unfair labor practice charges with the National Labor Relations Board regional office in San Francisco.

Because California does not have Right to Work protections for its workers, Massen, who elects to refrain from formal union membership, is still forced to pay union fees as a condition of employment. However, because of a National Right to Work Foundation-won Supreme Court precedent in Communication Workers v. Beck, she cannot be compelled to pay the portion of union dues used for the union’s political, lobbying, and member-only activities. Union officials are also legally obligated to inform workers of these rights and to provide workers with an independently verified audit of chargeable and non-chargeable expenses.

Service Employees International Union (SEIU) United Healthcare Workers – West union officials refuse to provide the Center’s nonmember employees with the disclosure Beck requires. SEIU United Healthcare union officials also require the workers to annually object, a tactic designed to force workers into paying full union dues. Foundation attorneys defeated the annual objection requirement of another union before the NLRB earlier this year.

Additionally, this union requires employees who choose not to join the union to provide their social security numbers to refrain from supporting the union officials’ non-bargaining expenses, further discouraging workers from exercising their rights.

Labor Board Announces Prosecution of SEIU Union Bosses for Illegal Union Membership Opt-Out Policy

Illegal union procedure forces nursing home workers to pay full union dues

Princeton, WV (April 6, 2010) – The National Labor Relations Board (NLRB) regional office in Winston-Salem, North Carolina has issued a federal complaint against a local union for maintaining an “annual objection” policy designed to force nursing home workers into full union dues payments against their will.

The complaint stems from multiple charges filed by six employees from the Princeton area of West Virginia against the Service Employees International Union (SEIU) District 1199. The employees – Sherry French, Walter Coeburn, Tammy Tyree, Bruce Hoyle, Debra Fitzko, and Deborah Dunn – filed the series of charges with free legal assistance from staff attorneys at the National Right to Work Legal Defense Foundation.

The six employees challenged the SEIU District 1199 hierarchy’s policy which violates Foundation-won precedent in the U.S. Supreme Court decision in Communication Workers of America v. Beck (1988), in which the Court held that union officials can not lawfully compel nonmembers to pay the part of union dues spent for non-bargaining activities like political activism, lobbying, and member-only events. Foundation attorneys are currently challenging many union boss schemes similar to the SEIU District 1199 union bosses’ annual objection policy, often concocted by union brass to burden or thwart employees from exercising their rights under Beck. Five NLRB administrative law judges have held such schemes unlawful.

Employees File Federal Class Action Suit to Halt Abusive Mandatory Union Dues Scheme

Right to Work Foundation helps employees challenge national union’s illegal “annual objection” policy

Aberdeen, MD (September 21, 2009) – Today, two employees filed a class action federal suit challenging the International Association of Machinist and Aerospace Workers (IAM) union’s nationwide policy requiring employees to object year after year to paying union dues they cannot be lawfully forced to pay.

With free legal aid from the National Right to Work Foundation, Jacobs Technology Incorporated employees Rick Gorham and Robert Negosta are challenging the IAM union officials’ scheme intended to thwart non-union members’ legal rights to refrain from paying union dues for union electioneering and other non-bargaining activities. Foundation attorneys filed the complaint in Maryland’s U.S. District Court on behalf of the two employees and all of Jacobs Technology’s other similarly-situated employees.

In the Foundation-won Communication Workers of America v. Beck (1988), the U.S. Supreme Court held that union officials can lawfully compel nonmembers to pay union dues as a job condition, but not the part of dues spent for non-bargaining activities like political activism, lobbying, and member-only events. However, these limited rights have been difficult to enforce, as union officials often concoct illegal schemes such as these “annual objection” policies to burden or thwart employees from exercising their rights.

Union Officials Use Annual Objection Schemes to Hamstring Employees

When hard-working employees object to paying forced dues for politics, they mean it.

But despite such opposition, union officials will try to find every way possible to demoralize and hamstring employees so that their forced dues money continues to follow into union political coffers.

Take a look at Robert Prime from Pensacola, Florida. Mr. Prime works at the Naval Air Station. In December 2003, he filed charges with help from attorneys at the National Right to Work Foundation after IAM union officials told him he had to object every single year to paying for union political advocacy.

IAM union officials refused to acknowledge that his objection should apply continuously. And while Mr. Prime fights for his objection to be honored, he and his coworkers are forced to oblige to a burdensome and discriminatory policy until a decision is issued after a hearing scheduled for the end of this year.

It took nearly four years for him just to get that far. But Mr. Prime and his coworkers in Florida are not alone.

Just months ago, the NLRB delayed another ruling where George Gally, a 40-year veteran at Colt Firearms, requested that the federal board rule on his case under similar circumstances.

Right to Work attorneys helped Mr. Gally of Connecticut originally file unfair labor practice charges in 2003. His charges challenged the United Auto Worker (UAW) union’s nationwide policy of requiring employees to object annually in order to receive refunds of forced union dues spent for union political activities.

But the NLRB, with its reputation for dragging its feet, refused to rule on Mr. Gally’s precedent-setting case and punted the decision back to a Regional Director for further review.

As a result, Mr. Gally has no choice, like Mr. Prime, to wait longer for a ruling as union officials continue to enforce bogus hurdles designed solely to keep rank-and-file workers in line.

Union officials do not require the same of their members. So why do they require those employees – who do not want to pay for union political activities – to object every year?

The answer can surely be heard in the “cha-ching” of union bosses’ coffers.
